Agency orders Colorado fleet to cease operation due to vehicle condition

E & K Trucking, based in Commerce City, Colo., has been ordered by the Federal Motor Carrier Safety Administration to cease its operations after an investigation showed the company was still operating vehicles previously ordered out-of-service by the agency.

The imminent hazard out-of-service order was announced June 18. E & K is a small fleet, FMCSA says, and it hauls construction scrap and debris. The agency said during its investigation it discovered that the carrier did not routinely inspect its trucks, nor maintain or repair them. All vehicles inspected by FMCSA in June were issued an out-of-service order for “serious safety violations,” FMCSA says.

“Company owners that cannot or will not abide by the safety regulations will find their business shut down while facing civil, and possibly criminal, penalties,” said FMCSA Administrator Anne Ferro.

The fleet’s owners are also facing fines of up to $25,000 and could face possible criminal charges and imprisonment if they do not comply with the imminent hazard out-of-service order.
