NJ bill bars owner-operators from drayage, gov. may veto

| June 03, 2013

New Jersey Gov. Chris Christie has not said if he will sign a bill that would bar owner-operators from drayage and parcel delivery service.

Business groups oppose the Truck Operator Independent Contractor Act while labor organizations support it. Still, both sides have speculated on a veto vote from the Republican governor, who’s campaigning for his second term.

On May 30, the state Senate voted 21-17 for the bill after the Assembly cleared it with a 43-30 vote.

The legislation creates the presumption of an employer-employee relationship in the drayage trucking and parcel delivery trucking industry. If signed into law, trucking companies considered in violation could be fined $100-$1,000 and receive administrative penalties of up to $2,500 for a first violation and up to $5,000 for each subsequent violation.

Just wait, It gets better, the Teamsters are in Savannah,GA as we write trying to sneak the California Clean Port Truck Campaign in the back door while telling owner/operator truckers “we are here to help you” ! Yes sir, they want to help the owner operators alright. Right out the door while creating a workforce of employee only drivers on company owned trucks. This clean truck strategy makes it easier to unionize a work force that doesn’t fall under (independent contractor status). All good for the union very bad for us..They’ll make trucking so damn expensive with their mandatory DPF filters and then onto new truck only regulations that GA/SC owner/operators will disappear from the planet.Truckers we don’t need this BS. What we need is aggressive enforcement of federal “truth-n-leasing” regulations and we need to educate new drivers to the fact that you can’t work for peanuts and expect to carve out a decent living in the trucking business. This clean truck campaign doesn’t only effect hauling containers from the GA port but eliminates all owner/truckers from working in this area so O/O beware! Do you really want some union or ms-informed legislators to decide if you have a right to ownership in America? If you don’t care just continue to take no action…
