Obamacare: Decision upcoming for uninsured operators

| August 21, 2013

The consultants at owner-operator business services firm ATBS have put together a helpful primer on the particulars of the Affordable Care Act, also known as Obamacare, as part of a regular newsletter you can download via this link. The piece is intended to help owner-operators make the decision about what route to take for health insurance under the act — without some kind of coverage come tax time in 2015, individuals will pay a penalty. Such penalties grow to as much as $2,085 or 2.5 percent of total income over $20,000, whichever is greater, for tax year 2016.

Put together by ATBS Tax Manager Andy Erwin, the informational piece also details various metrics that owner-operators currently without insurance can use to make their decision, including dollar figures for potential subsidy assistance if purchasing on the newly established individual health-care exchanges. Enrollment in the new exchanges is scheduled to begin October 1.

Given the delay in the mandate for employers of more than 50 individuals to offer an insurance option, many have suggested a delay in the individual mandate should also be granted. Tell us what you think in the comments here.

Some exemptions to the individual requirement to have health insurance under the ACA do exist. The following chart from ATBS’ newsletter shows them.

Another notch in the coffin of the small business trucker. Personally, as a owner operator I have insurance on my wife’s policy at her employer. But like UPS just did. It dropped any spouse who had insurance available at his or her employer. Except for the Union people of course. I would not worry too much though. So far Obama care has been riddled with delays and re writes and waivers. This piece of legislation is dying fast and its going to upset so many people that the Democrats will surely repeal a lot of it before midterm elections.

I don’t plan on ever getting insurance, I’ll pay the penalty it will be cheaper. And if nobody signs up for it I think is the only way they will get the point that we don’t want them controlling every aspect of our lives.

  • Doug

If this garbage called Ostupidcare is so wonderful, why isn’t every politician and government employee forced onto it?

Other than the couple of mental migets posting with their childish verbage several post have been thought out. I wonder how many drivers are VETS. I have medicare and the VA. If either one or both are not good enough that tells me there is a serious problem that Obama had nothing to do with. Just what is it that is so hard for some to see wah t is going on. simply put obama is a puppet. However he is the head puppet. This country is heading for third world classification and we are doing nothing to stop it. I hope I am wrong but all the evidence points to him doing what Castro did. Declared him self president for life when elections failed to put him back in office. He who controls the transportation controls the country. A dictator cannot be impeached.

  • Washington Trucker

Owner -Operator with MS. I must purchase insurance for myself and none for my husband (owner-operator too) and children 15 and 8. Soooo expensive I don’t know what to do!! I voted REPUBLICIAN and will continue to do so but it does not seem to matter. Truckers make the world happen, why is everything gotten so outta hand??

  • Stacey Moritz-Erb

Hell , they use it for prenatal care.

  • lfhpueblo

They’ll take it from your income tax return, also give you penalties, and you may even owe the government. Don’t pay them and they’ll come for your truck. Whoever voted this guy in, well all I can say is I hope they stick it to you like they’re going to stick it to everyone else that didn’t vote him in.

  • lfhpueblo

They are going to get subsidies that the tax payers are going to have to pay for. Yep, the rich Congressmen/women and their aides voted themselves subsidies at the tax payers expense.

  • lfhpueblo

Can only hope it will be repealed.

  • lfhpueblo

Socialism and their agenda that has really been ongoing since at least the 1920’s, though there was some of it uprising in the late 1880’s. One World Government agenda. Ever see the movie Wag The Dog? So much of what is going on in the world right now is being staged as a way to bring in martial law and then have everyone under a global ID system. Everything mobile being followed by GPS systems, everything over internet or phones being copied or recorded. It’s Big Brother in all aspects of life. It’s the taking down on purpose of governments to force in the UN’s 10 world grouping of land mass. The USA will be a unit with Mexico and Canada. Other countries will be grouped with countries in their area as another unit. Why do you think Obama doesn’t really want border police catching anyone or doesn’t want a wall put up? He wants to go along with the agenda that the private citizen is not suppose to know about by the controllers. Power comes by control, and they are exerting as much of it, even illegally as they can to keep on their time line. Kissinger wanted everyone biochipped by 2017.

  • Opt Out

You seem to be racist and illiterate ,and homophobe.Don’t buy insurance.who cares.Where are you going to go for health care? Most hospitals won’t take you.doctors are not obligated to take uninsured. If your wife or girl friend has a child are you going to deliver it?You an imbarrasment to the republicans.T bag$$rs.

  • Opt Out

Read the Obama care bill? You all must be watching fox for info. The Va has info on it if you can’t understand it. It is a chance for everyone to get affordable Heath insurance. If you opt out then there is a small fee.Hospitals and doctors like it because now they can get paid for services.primary care doctors used to loose money from people who got service but never paid because of no insurance or they did not pay the 20 percent that insurance is not responsible for .hospitals for years never got reimbursed for non insured and auto accident victims because health insurance does not pay for motor vehicle accidents. They have to write it off and doctors come out of med school owing hundreds of thousands in student loans. They can’t work for free .Drug companies are not making certain drugs that were very important to cancer and heart because they were forced to sell it cheaper then the cost it took to develop it .It is your choice,to go to a doctor or not.

I believe we can still set up a health care savings account (MSA) along with a catastrophic insurance policy. Odds are my wife’s insurance, through her employer, will drop me and maybe even herself too. If the MSA doesn’t work, we are looking at a cash only medical concierge service, much cheaper than Obamacare.

  • Robert Branch

I used to have a HSA, but those won’t be allowed under the ACA. HSA could have solved the whole coverage problem without a government takeover. It’s about control, that’s all.

  • localnet

It is far from affordable… The bulk of the costs will be thrown onto the backs of employers and 20 something’s. And we are already seeing how the employers are reacting, cutting hours and or just shutting their doors.

This is going to get ugly, especially as we are moving towards a European 20 hour work week. Having to work for two to three employers to make less than I would with one employer does not bode well for younger Americans, especially if amnesty passes. Which will flood the country with 30+ million illegals that are exempt from obamacare, and more than likely headed straight to the local welfare office for all of “their” freebies.

If you use honest numbers to figure the true unemployment rate, we are hovering between 24 to 30% real unemployment.

An influential Charlottesville, Va., money management team claims that Obamacare has forced many firms in Thomas Jefferson’s hometown to switch to part-time workers, and that one manager was told he’d be fired if he hired a 50th full-time worker, the number that triggers the costly health care system.

“Economic self-defense has many firms forcing their employees to work less than 30 hours a week regardless of their preference or availability. This trend seems to be universal even here in Charlottesville,” David John Marotta and Megan Russell of Marotta Wealth Management said in an online memo to investors. The firm handles many Charlottesville investors.

They added: “We hesitate to name all the businesses in town that are cutting employee hours below 30. Even though the list includes almost all major franchises, most firms have been smart enough to keep the changes as quiet as possible.” The reason: “The backlash and boycotts have been harsh and vitriolic from liberals.”

Sign Up for the Paul Bedard newsletter!
Nonetheless, firms have been just as tough on managers in Charlottesville, ordering those that run smaller companies to keep hours and full-time workers below the Obamacare base level of 50. Going over 50 means firms will either have to start offering health insurance or pay a significant fine.

“These smaller companies have a great incentive to keep their employees under this magic number,” wrote Marotta and Russell. “We heard that one local firm told a business manager that if he allowed the hiring of a 50th employee, he would be fired to bring the number back under the limit.”

The duo note that Obamacare is also hurting larger firms that can’t cut employee numbers below 50. They give an example of a firm with 530 full-time workers and explain that a $1 million fine will be required if the firm doesn’t offer health insurance. But, they add, it’s still cheaper than offering the insurance “because government regulations more than double the cost of health care on younger workers.”

Their memo suggests that Obamacare is resulting in a “jobless” recovery.

“This is part of the reason why employment statistics show part-time employment on the rise while the number of hours being worked remains constant. It also explains the economic benefits of outsourcing, sending jobs overseas or using technology to replace workers. These alternatives to employment can save money by avoiding the Obamacare employer mandates even if they appear to cost more on paper,” wrote the money managers.

Illegal aliens are exempt? This whole issue is Kafkaesque.

  • David S. McQueen

They will take it out of your federal income tax refund. The IRS is in charge of enforcement of ObamaCare.

I am self employed i do not get money back!!!! Are people like you ever going to fight back David? Or will you continue to take it up the rear from these people? I absolutely refuse to be a part of it.

We were screwed the day that J/A was elected = His “YES WE CAN” was his way of saying yes we can screw these people , worst President ever,

  • jerisweeney

So do you think that the rest of us who pay for our health insurance should continue to pay for your medical bills when you wind up in the emergency room? The medical industry tacks on 40% to our costs in order to recover their losses from deadbeats. Unfortunately that’s the way it’s been for many years and it’s the reason health care costs have risen to the moon. I’m frankly tired of carrying every deadbeat around on my back. Obamacare will get you off of it.

big….you don’t have a clue what your saying. Others out here aren’t steering wheel holders. We work for ourselves, and file our own PENALTIES! I’m not paying it, the gov can not make me buy anything…..it’s not a tax, it is what it is a penalty!

  • USMC 69-75

If EVERYBODY refused to pay this “PENALTY”, then maybe we can get it defunded!

They can not impose any type of service, or product upon us. The supreme court ruled it a “TAX” because they can not “PENALIZE” us for not buying this junk! We need to all stick together and tell them to pack salt. But we can’t even get the trucking industry to stick together, so the sheeple will go to slaughter. “The cheese in the mouse trap is free”

The amazing thing I’m seeing in most comments about this ‘ObamaCare’ is that almost no one has done their own fact checking. Virtually no one has found what actually are the OUT-OF-POCKET costs to the individuals posting here. The facts are that if you are a operator, with employees that you presently provide insurance for, it will actually be cheaper in the future to insure them individually than it is under a group policy. The same holds true for individuals. The out of pocket costs for individuals are offset by tax credits -or, in some cases subsidies, which bring in the true costs at -or, below current rates. Now don’t forget, I’m comparing ‘apples to apples’ here. If your uninsured or have employees that you can’t afford to insure, you’ve got bigger business problems than any mandatory insurance requirement is going to be.

  • David S. McQueen

I don’t make the rules. And it’s people like you who whine about all this and never DO anything. At least I understand how the system works and I try to change it. You had no idea which federal agency enforces ObamaCare or that the USSC determined the penalty is a TAX.

  • M.j. Zuzich

And, you pay them what your tax returns tell you that they are owed.

  • M.j. Zuzich

John, UPS can only drop spousal coverage on non-union employees which largely, would be those who are management positions.

  • M.j. Zuzich

After scrolling down I see someone who’s actually ‘got it’ -almost. Since over 50% of those who chose to vote in the last two national elections voted for this sitting President -myself being in that majority, not a one of those voters chose to “stick it you.” You might want to ask those in Congress who chose to not try to make this plan more to your liking sat on their hands for the last four years. Like it or not, Obama Care is a form of national healthcare that our biggest employers have been asking for over the last several decades.

  • localnet

And who exactly will pay for this? One only needs to dig a bit to see… The number one employer in the USA is now Kelly Temp Services… Unemployment according to the latest numbers via Gallup are at 9% and rising quickly… Ain’t nothing free baby.

  • M.j. Zuzich

If you really are an o/o, you sound like you’ve got a really scary business plan. You do have a plan -don’t you?

  • M.j. Zuzich

In all of the pro and con ObamaCare comments I’ve seen over the last four years, the only places I’ve seen the word “free” come up is in comments that come from those opposed to any form of government mandated health care.

  • M.j. Zuzich

Call it whatever you want. If it’s a tax liability, your going to pay it or life as you know it will see major changes.

  • localnet

Alright smarty pants… What are the actual costs? As of today no numbers have been released, we have to wait and see what is in the bill! Jackass,
