Supreme Court to decide whether to hear cross-border case, FMCSA admits 14th carrier

The cross-border trucking pilot program with Mexico will continue, as a federal court has ruled against both cases filed by the Owner-Operator Independent Drivers Association against the program.

The justices will decide Jan. 10 if they will review the Owner-Operator Independent Drivers Association’s appeal of a lower court’s ruling that allowed the program to continue. In July, a federal appeals court had rejected the association’s request for a rehearing after it had ruled April 19 in favor of the Federal Motor Carrier Safety Administration. 

Meanwhile, the most recent carrier to receive authority under the program is Trasco, which will use four drives and seven trucks to operate beyond the commercial border zone. The FMCSA is pending decision on admitting two additional carriers, Transmex Inc. SA de CV and Road machinery. 

Mexico has indicated it will reinstate retaliatory tariffs if the program is disrupted, according to this year’s Department of Agriculture third-quarter report. The three-year program began its final year last October.

Half of Mexican carriers in program gain permanent U.S. operating authority

FMCSA has granted permanent authority to half the Mexican carriers participating in its pilot program. It's also preparing for comment on a new applicant.

The agency had stated it would need 46 participating carriers to obtain a target of 4,100 inspections, the number it indicated necessary to provide a statistically valid analysis of the pilot-program participant’s safety performance. 

The FMCSA’s Nov. 24 summary of participants’ safety data noted the agency was investigating Transportes Olympic over a possible hours-of-service violation and had placed one GCC Transporte truck out of service.

    If carriers comply with all the regulations whats the problem?
    If they don’t put them out of service, have them put a 100K bond or something we have to start some were or what do you suggest bring back the Indians?

    i say to hell with the mexican trucks in the us let them bring it to the border and drop it, no sane american driver would even want to go into mexico and all the officals and police are corrupt, and if they put the tariff on american products then america should tariff all the stuff that are made in mexico by the companies that left america for the cheap wages.we are already over run with wet backs now about 12 million of them

    John, the 46 carriers is a number FMCSA pulled out of the hat. DC Court of Appeals in shooting down Teamsters arguments rules that number is not set in stone. There are four years of stats that will prove that Mexican carriers in General have better safety records than we do. hell, the Canadians have better records

    Totally agree with godfearingrebel. All carriers need to be held equally accountable. If a U.S. company got that kind of preferential treatment heads would roll, charges would be filed, and FMCSA people would lose their jobs. And yet they can let Mexican companies operate unsafe on U.S. roads because the Mexican government threatens the U.S. with issues related to getting more money from the U.S. Come on Mexico, where is your pride? Mexican citizens I know like to know they earn what they get and don’t want a hand out. Citizens of Mexico should be embarrassed that the U.S. FMCSA feels these hard working people need a handout!!!

    There are many, many already Mexican drivers here in our trucks. Taking care of equipment is not their goal, understanding our documents is a struggle for them. However they are allowed to drive because they work cheaper.
