Agency publishes logging device rule, taking public comment for 60 days

PeopleNet_TABLET_Incab_eLogsScreen_062013The Federal Motor Carrier Safety Administration’s latest attempt at an electronic logging device mandate has been published in the Federal Register as a Supplemental Notice of Proposed Rulemaking, and the agency will accept public comment on the proposed rule for 60 days.


Logging device mandate could come in 2016, outlines hardware spec’s, harassment provisions

The rule addresses driver harassment protections, hardware specifications and hours of service-related supporting documents.

The rule, when made final, will require all truck drivers who currently must keep records of duty status to use an electronic logging device, formerly known as electronic onboard recorders.

After the 60-day comment period, the agency will begin work on crafting a final rule, which is likely to be published later this year.


New rule includes 8 ways to help prevent e-log harassment

FMCSA outlines eight proposed provisions to attempt to prevent driver harassment with ELDs. Congress and the courts directed FMCSA to include safeguards against driver harassment ...

The effective date of the mandate would be two years after publication of the final rule, so likely late 2016.

The agency with this rule was directed by Congress and the courts to include more provisions to protect drivers from carriers using the devices to harass them. Click here to see Overdrive’s look at the eight harassment provisions included in the rule.

    They are talking about harassment from corporations NOT state harassment from public officials! Got it???
    DOT can order you to move that truck follow you then ram a ticket down your throat like they used to do in the poor parking state of Virginia.
    The states are gonna rip drivers off left and right because drivers don’t have the b***s to take their rightful place as kings of the highways.
    Homosexuals are more organized and far more bolder than the so-called he-man truck driver! Straight up!
    He’s too busy arguing on the CB radio about politics and or who cut off who or what race a man is when the enemy is in his backyard or should I say he is driving for the enemy.
    If you work for a large trucking company then you are the problem because you fed the monster and now he turned on you and the rest of the industry.
    I immediately left a large company when I found out they lobbied for this law and thus I have done my part. How a bit you Mr. Truck Driver? Is it too much to ask that you leave the beast that turned on the industry?
    Our founding fathers died for freedom and democracy and they sweat hard and walked great distances ate the worst food etc I could go on but you get my drift yet you find any reason not to do your part and take down the beast.

    Mr. Truck Driver you are triffling at best at worst you are not a man and the former drivers are rolling over in their graves vomiting at what you have allowed to take over the industry….. Fascist!!!

    Please make your comments known. One point that I believe could cause this rule to be determined unconstitutional is the fact that it is just an “Ankle Bracelet” for trucks that have not committed a crime.

    The fact this will increase the cost of doing business should also be addressed. This is collusion by Big Business with the help of the Federal government, to force their small business competition out.

    I will be printing the ruling including links and phone numbers. I will then start passing these flyers out to concerned Truck Drivers asking them to join the fight.
    It’s long past time for Us to Stand United and let our Voices be Heard.

    Three ways to send a message
    1. Inform your carrier and Congressman that you will be taking off at least 3 days during the week of 10/31 thru 11/7.
    2. Register to Vote and then start making calls to your elected officials in DC. Call 202-224-3121 and inform them of your issues.
    3. VOTE. I’m Shutting my truck DOWN 11/31 thru 11/7 TO MAKE SURE THAT MY VOICE IS HEARD!!!

Quail com invested boo koo bucks to obama to have his DOT get this passed where all trucks have to have these expensive recorders in all trucks just think how much quail comm will make on this deal. Just look at how much money quail com gave obama big big bucks.Its all a payback!!!!!

    There is no logical reason a free person in the USA should be forced to do any of this …an un-elected people making decisions for industries they have no working experience in. I have run both on paper and on e-logs and there is a difference. I know that when or if this becomes final i am surely going to get out of the truck.
    All the tech nerds, Quallcomm, drivewyze, etc..all are promoting this for their own monetary interests .

    I don’t run an EOBR or a paper log as i am a local hauler , however , that being said , what i wonder is why didn’t ya’ll raise more cain when they threw out the medical changes and jammed them down our throats ? Big Pharma stood to make a killing and now that this “sleep apnea” crap has passed and the BS about BMI and neck circumference they are now making said killing off of all our backs . Why can’t truckers stand together anymore ? Are we all that juvenile and brow beaten that we lay back and say ” huh , not gonna bother me.” ? Quit blaming it all on Obama and start to realize where the blame really lies , ourselves , for being sheep and following along with the herd for so long . BTW before you attack me for saying quit blaming Obama , you should know I can’t stand the darn commie myself and cannot wait to see him out of the White House .

    How about a Federal Mandate that companies have to check on drivers over the weekend and confirm they are ok. That way drivers will not have to decompose in thier sleepers. How about the Federal govt impound and inspect vehicles through OSHA DOT or someone rule trucks out of contributing to accidents or deaths in sleepers. You log out but no one cares if you log back in.

    Hello Judy, perfect timing. Today,I finally found the time to write up my flyer. I will be at Office Depot first thing to print a hundred or so.
    I have been talking with many Drivers about this simple way to send a message. I do not get political, I only have to bring up ELD’s and Speed Limiters to start the conversation.
    I bring up “Three Ways to Send a Message” and after a moment I see a gleam in their eye. Drivers get it!
    I will use this flyer to reach out to more Drivers and to speak with them further if they so choose.
    I have this flyer in PDF format so that I can email it any other Driver if they would like to spread the word. I printed 25,000 flyers two years back for about $180.00 so it shouldn’t be that expensive to print a hundred or so.
    I would be happy to email it to you or any other Driver.
    If We Don’t Do IT, IT aint gonna get DONE.
