ATA, OOIDA fight hours of service in court

The ongoing fight between the American Trucking Associations and the Federal Carrier Motor Safety Administration over the upcoming changes to hours of service rules continued Friday, March 15, in a Washington, D.C., court of appeals, where both sides presented oral arguments to a three-judge panel.

FMCSA made the rule final in December 2011, and the changes will go into effect July 1. ATA says FMCSA doesn’t understand the science that went into the rulemaking, specifically the 30-minute mandatory break. It’s arguing, too, that the rule would restrict drivers from being able to manage their schedules effectively.

The Owner-Operator Independent Driver Association has intervened into the case on the side of ATA.

Public Citizen has also sued FMCSA and its presenting arguments in the case. It, however, has sued the agency because it says the hours rules are not restrictive enough.

The court has not said when it will release a ruling.

    By YEAR END Obama will have his Amnesty..and 11million “guest workers” will be getting a CDL..with the help of the ATA who is lobbying for it…….wages and rates will be at an all time LOW and the Rich will be very HAPPY.

    Well, first off, if you weren’t there you have no idea what you’re talking about.. What you’re quoting is federal bull shit about 5 to 10% of truckers back then…. You want to talk about cheap freight haulers back then, well lets get real.. JB Hunt was the under cutter of all freight rates, along with his buddy CL Werner. If you’ld haul it for 90 cents, they’d haul it for 80 cents… Canadian haulers would rather stop JB Hunt at the border and burn the trucks than let them cross the border.. The same would happen to Werner trucks, but CL had enough sense not to try and cross the border… So my fine feathered friend, it appears to me that you know of what you speak.. Therefore you’re either a Union man or stupid as hell… ither way you’re not qualified to speak to me or any other owner operator that has endured the past 20 to 30 years… We got you to where you’re at to day as far as rates and surcharges.. The rest of the bull shit has been brought on by yoou “school boyus” that don’t know feces from peanut butter!!!!! You donot have the expirence or the right to talk to me, so don’t bother talking to me any more, cause I won’t answer… You my friend are an IDIOT……..

    Oh it’s embarrassing allright….most other guys in the TRADES will laugh at the truck driver making “boy money”..like a kid on a paper route!!! 80 hours a week and you sleep in a tin box on the Job..and you take home HOW MUCH??? aahahahahahahaha…LOL.

    80 hours a week? More like 14hrs/day x 7 days = 98 hours per week. After a while, I realized that the company’s 2000-2100 mile ‘guarantee’ per week was 300 avg miles per day, 7 days a week! (Major company with 2000 well-maintained trucks with APUs, large in the Wal-Mart distribution world. Lots of freight, though, so you never sat around truck stops.)
    Yeah, no overtime, all straight mileage. Wait six hours to load without an appointment, no problem… no pay! After all, it’s not a job, it’s a ‘lifestyle.’ (And Arizona’s a dry heat, right?)
    I don’t think the country realizes the sweat shop conditions OTR and Regional drivers work under.
    Sadly, it’s the Big Trucking Companies who laugh at us. ‘Make Big Money’ say the adverts on CraigsList. For every ‘good’ long load, dispatch saddles you with a short ‘stinker’ load in front of it. As P. T. Barnum said, “There’s a fool born every minute.”
    Yup, you have it there–OTR truck driver making paper route money… my 5 month take home $158-$825 week. ($158 take home is NOT a typo.) Avg gross $450-$650 week. $450 / 98 hours = $4.60 hourly, way less than minimum wage!!

    us a truck driver law is every step of the truckers way witch is fine but the law never protect the drivers.. like a company driver the corporation who got the money they making this up along the way to choke a regular Joe if you want us to work less hour why not pay us per hour you well clean this BS in a heart bet because ELECTRONIC LOGS THEY CAN RECORD EVERY TIME THE TRUCK MOVE AND WHEN THE DRIVER START HIS OR HER PRE TRIP IT MEANS HIS OR HER CLOCK WELL START UNTIL THE END OF HIS OR HER 11 and 14 GET IT
