FMCSA medical certificate rule begins

Jill Dunn | January 30, 2012

Beginning today truckers must keep paper copies of their medical examiner’s certificate with them for another two years until Jan. 30, 2014, under a Federal Motor Carrier Safety Administration’s rule. Carriers also must keep paper copies of their drivers’ certificates until then.

This rule is a follow-up to the agency’s Notice of Proposed Rulemaking, issued last June, which proposed amending a 2008 final rule.

That 2008 final rule required CDL holders subject to federal physical qualification provide an original or copy of their medical examiner’s certificate to their state driver’s licensing agency. State agencies must post the medical certification information in the Commercial Driver’s License Information System, the federal electronic database.

After the 2008 final rule, several states told the FMCSA their offices lacked the capacity to comply by today’s deadline. The agency extended the paper copy requirement for interstate CDL holders and carriers two years to provide sufficient overlap for state agencies.

However, the FMCSA did not extend the deadline for state agencies. Beginning Jan. 30, drivers applying for or renewing CDLs under the non-excepted interstate category will have to self-certify and provide the certificate or a copy to the state licensing agency. All drivers affected by the rule will have to comply by Jan. 30, 2014.

More information on the final rule, FMCSA-1997–2210, is available here.

OOIDA is 155,000 strong; correct me if I am wrong. Then WHY do OOIDA
members pay the price they are paying at the pumps? Big Trucking
Companies get $.40 to $.43 off the price at the pumps. By the way, it’s the
very same pumps where, WE pay full price. This is a CRIME!OOIDA has
155,000 members, more than any Trucking Company in this country. Even
half of 155,000 is greater than any Trucking Company. Its time for change.
What’s good for them should be better for a lot more. The price of fuel is
going up! The rates and brokers and the Truck Stops are raping us. I must
be missing something here. If OOIDAgets this done then I and many more
will give 100% of our support to OOIDA.To survive we have to arrive. I
would like to become a member, but every time I go to the pumps, they get
Memberships at OOIDA could double very quickly with just this one issue.
Every Owner-Operator in this country would jump at the opportunity to get
the same discount these Trucking Companies are getting. This is something
that Needs to be addressed NOW. We cannot AFFORD to wait. If this letter
falls on deaf ears, then OOIDA may also fall. Then the Trucking Companies,
Fuel Companies, and our dear Government, who all seem to be in bed
together, will WIN. This is another nail in the Owner-Operators coffin. Now
is the time to stand up! Let’s push the nails out and double OOIDA
Membership and show these folks. If one Owner-Operator falls, WE ALL
FALL! Let’s Unite ALL Owner-Operators NOW!
Contact OOIDA Today. Don’t wait another day. Tell them you want this
done NOW!If they want your continued support, then take action NOW!
