OOIDA in latest legal filing: ELD mandate too costly, too intrusive
OOIDA again argues in its latest brief the rule violates truckers’ 4th Amendment protections against illegal search and seizures and does not meet Congress’ requirements for the rule. The group also argues the mandate still opens the door for truckers to be harassed by their employers via the devices and does not stand up to a cost benefit analysis.

Brokers see ELD data as opportunity to find trucking capacity
As electronic logging device adoption grows ahead of the December 2017 effective date of the U.S. DOT’s ELD mandate, brokers and other third-party logistics providers see an opportunity to use hours-of-service data gleaned from the devices to find available trucks and drivers.

FMCSA declines to file response to motion asking Supreme Court to hear ELD lawsuit
The latest on the renegade effort (of sorts) by trucker William Trescott to intervene in the OOIDA-brought lawsuit seeking to strike down the DOT’s electronic logging device mandate. Trescott this month asked the Supreme Court to take up the matter.

Following a comment dust-up over the real costs of compliance of an ELD mandate, the agency relaxed certain portions of required device spec’s in the mandate’s ultimate version. But it also blocked attempts at exempting small trucking companies from compliance.

FMCSA sent the e-log rule to the OMB July 30, along with a rule that will implement stiffer penalties for carriers, shippers, brokers and others who coerce or pressure drivers to not abide by federal safety standards like hours-of-service limits.

GAO studying FMCSA predictions vs. reality on hours rule, ATA says in regulatory, legislative update
