A group representing fireworks haulers is seeking an exemption from the 14-hour hours-of-service rule for three more companies during the Independence Day holiday period.
The American Pyrotechnics Association has had an exemption that allows fireworks haulers to drive beyond their 14-hour on-duty clock after 10 consecutive hours off-duty for the last 11 Independence Day holiday periods. Currently, 50 of its member companies can operate under the exemption. It is now asking the Federal Motor Carrier Safety Administration to include Artisan Pyrotechnics, Montana Display Fireworks and ZY Pyrotechnics, dba Skyshooter Displays in the exemption.
Drivers that can operate under the exemption are all hazmat-endorsed CDL holders. According to APA, they transport fireworks and other equipment during the Independence Day holiday period, then are often responsible for setup and staging of the fireworks shows. Once that is complete, they had several hours off-duty in the afternoon and evening before the fireworks display.
The three new companies would be granted the exemption through July 8, 2020, which is the same expiration date as the 50 other APA member companies.
FMCSA is seeking public comment on the exemption request for 30 days after the notice is published in the Federal Register on Friday, June 8.
