GAO studying FMCSA predictions vs. reality on hours rule, ATA says in regulatory, legislative update

DOT: Proposed speed limiter rule coming in Feb., insurance increase next month
A federal regulation upping the amount of liability insurance carriers must have is still slated to be published as a proposed rule next month, while the department’s rule to require use of speed limiters on heavy trucks and its Safety Fitness Determination rule are now projected to be published as proposed rules in early 2015.

Carrier groups want expansion of drug database rule, petition FMCSA
Some trucking and enforcement groups have asked FMCSA to expand its drug and alcohol clearinghouse rule to require carriers to report “actual knowledge” of drug use by drivers. OOIDA says such “unverifiable” information should not be used against a driver.

FMCSA published Feb. 20 its proposed rule for establishing a database of drivers who have failed or refused a drug test — dubbed the Commercial Driver’s License Drug and Alcohol Clearinghouse — and the agency is accepting public comment on the proposal until April 21.

Driver database rule made official: FMCSA unveils rule to implement drug/alcohol clearinghouse
A proposed rule establishing a database of CDL holders who have failed or refused to take a drug test will soon be published, FMCSA announced Feb. 12. The rule would require carriers to upload positive drug test results and query the database annually and when making new hires.

In its monthly update on significant rulemakings, the DOT has again revised the projected date of publication for a rule mandating Electronic Logging Devices, backing it up this time to Feb. 27. The drug and alcohol clearinghouse is projected to be published Friday, Feb. 14.
