In wake of Winter Storm Hercules and the extreme temperatures in impacted states, several states have issued exemptions or waivers of federal hours-of-service rules for truck drivers hauling fuel to or in those states.

Bill to overturn hours-of-service rule introduced in Senate, referred to committee
A bill introduced in the Senate last week that, if enacted, would halt the most recent hours-of-service rule change and allow truck drivers to operate under the pre-July 1 rules again, until Congress can review the rule further.

Short haul drivers who exceed the distance or time limits that qualify them as short haul drivers would be subject to complying with the mandatory 30-minute break required by the July 1 hours rule.

FMCSA says itâs planning a field study to gather more data on whether split sleeper berth time is an OK alternative for drivers. Separately, ATA proposed this week the agency conduct a 2-year pilot program to study split sleep.

Timber haulers in Oregon are seeking an exemption to the 30-minute break required by the hours of service rule that went into effect July 1, saying environmental and seasonal restrictions already limit their ability to get logs to mills.

A full 65 percent of the 4,000 truck drivers surveyed by the Owner-Operator Independent Drivers Association said the new hours of service rules have caused them to receive less income, while 46 percent report feeling more fatigued since the new rules took effect.
