Environmental, health groups challenge EPA's regs rollback in court

Environmental, health groups sue EPA over Endangerment Finding repeal

A coalition of health and environmental advocacy organizations filed suit Wednesday in the U.S. Court of Appeals for the D.C. Circuit challenging the Environmental Protection Agency’s recent decision to rescind the 2009 Endangerment Finding and subsequent greenhouse gas emissions regulations.

That 2009 finding allowed the EPA to regulate emissions of six greenhouse gases (carbon dioxide, methane, nitrous oxide, hydrofluorocarbons, perfluorocarbons, and sulfur hexafluoride). 

Announcing pullback from the finding, EPA said it considered and reevaluated its legal foundation and text of the Clean Air Act (CAA) in light of recent Supreme Court decisions. Those decisions “have significantly clarified the scope of EPA’s authority under the CAA and made clear that the interpretive moves the Endangerment Finding used to launch an unprecedented course of regulation were unlawful.”

In the new lawsuit, more than a dozen organizations petitioned the appellate court to review the rescission. The EPA itself and EPA Administrator Lee Zeldin are named defendants.

Sierra Club, one of the organizations that filed the suit, said “under the Clean Air Act, the EPA is legally required to limit vehicle emissions of any ‘air pollutant’ that the agency determines ‘cause or contribute to air pollution that may reasonably be anticipated to endanger public health or welfare.’”

The group pointed to a 2007 Supreme Court decision in Massachusetts v. EPA that held carbon dioxide and other greenhouse gases as “air pollutants” under the Clean Air Act. That decision led to the 2009 Endangerment Finding.

“In its repeal, the Trump EPA is rehashing legal arguments that the Supreme Court already considered and rejected in Massachusetts v. EPA,” Sierra Club added.

The group went on to call the rescission a “reckless decision” that “will have disastrous consequences for the American people, our health, and our shared future,” said Joanne Spalding, Director of the Sierra Club's Environmental Law Program. “In the early 2000s, the Sierra Club brought the first-ever lawsuit seeking federal greenhouse gas standards under the Clean Air Act, and as a result, these protections became a reality.”

Spalding added that it’s filing the lawsuit “because people should not be forced to suffer for this administration's blind allegiance to the fossil fuel industry and corporate polluters. This shortsighted rollback is blatantly unlawful and their efforts to force this upon the American people will fail.”

Pilot expands network with new locations, renovations

The Pilot Company recently announced the addition of two new Pilot Travel Centers, nine renovated locations and 13 new dealer locations to its network.

The two new travel center locations are in Findlay, Ohio, and Eagle Pass, Texas. “These locations offer guests a full array of amenities, such as freshly prepared food options, clean showers and restrooms and public laundry facilities,” the company said.

Nine existing locations also received “curb-to-counter renovations”:

  • Flying J in Myerstown, Pennsylvania
  • Flying J in Midway, Florida
  • One9 in Bismarck, North Dakota
  • Pilot in St. Cloud, Minnesota
  • Pilot in Bellemont, Arizona
  • Pilot in Van Horn, Texas
  • Pilot in Hebron, Indiana
  • Pilot in Buffalo, Texas

Finally, Pilot announced the addition of 13 “dealer” locations -- independent truck stops licensing the brand:

  • Pilot Dealer in Kaukauna, Wisconsin
  • Pilot Dealer in Itasca, Illinois
  • Pilot Dealer in Midlothian, Illinois
  • Pilot Dealer in Barry, Illinois

TA Express expands in Nevada with two new locations

TravelCenters of America this month opened two new TA Express locations in Wendover and Carlin, Nevada.

Strategically positioned along I‑80, both sites provide stopping points for professional drivers and travelers moving through northern Nevada.

The Wendover location, at exit 410, offers Sbarro Pizza, Bojangles, Del Taco and Black Bear Diner restaurants, along with an on-site deli, retail store and more. It also boasts 153 truck parking spaces, eight diesel lanes with DEF, showers, laundry facilities and more.

The Carlin location at exit 280 offers 50 truck parking spaces, a Bojangles restaurant with an on-site deli, five diesel lanes, showers, laundry facilities and more. 

The state of Nevada ranked just outside the top 10 for "best parking" among states in Overdrive's Highway Report Card survey report, tied for 12th overall.
