The agency granted exemptions to two waste and recycling companies allowing their short-haul drivers to operate for 14 hours instead of 12. FMCSA denied applications from three companies that asked for their drivers to drive beyond the current limits of the HOS regs.

Short-haul carrier asks FMCSA to expand short-haul exemption radius to 150 air miles
Palmetto State Armory says its drivers pick up and deliver products between manufacturing facilities and drive to PSA retail stores. The company states current operations include trips between 103 and 109 air miles. PSA says using ELDs or keeping logs “adds substantial costs to its operation and does not increase the level of safety.”

The executive order notes that Indiana is experiencing unseasonably cold weather, which has caused increased demand for propane to heat homes and businesses, causing a propane shortage in the state.

FMCSA denies request for 18.5-hour on-duty period from environmental emergency response companies
FMCSA in its denial said there is no basis to allow drivers to drive after the 18th hour of coming on duty. The companies noted its drivers would not exceed eight hours of driving time during a shift, but FMCSA said it doesn’t believe limiting drivers to eight hours of drive time offsets the safety risks of an 18.5-hour driving window.

Owner-operators took to various cities across California this week to air their grievances against the state’s new, restrictive law that could block owner-operators from working in the state. The protests come as moves Uber and Lyft could give trucking some leverage in landing an exemption from the California law.

Partial service has been restored for 99% of the Omnitracs devices affected by this weekend’s service disruption, says Omnitracs CEO Ray Greer. The temporary software patch is an interim fix until a permanent firmware update can be deployed, Greer said.

Trucker files class action lawsuit against CBD gummy manufacturer after failed drug test
Illinois-based trucker Trevor Darrow alleges that the JustCBD gummies he bought, manufactured by Just Brands USA, had a “No THC” label on the package. He tested positive for THC and lost his job after taking the product to help him sleep.

Wilson Logistics petitions FMCSA to allow pre-CDL drivers to run team
Wilson’s request would still require a CDL holder in the truck at all times, but not necessarily in the front seat. Wilson says the exemption would allow the CLP holder “to participate in a revenue-generating trip back to his or her state of domicile to obtain the CDL.”

Regs suspended in Midwest for truckers hauling heating fuel
The Federal Motor Carrier Safety Administration announced Friday, Nov. 1, it is suspending Parts 390 through 399 of the Federal Motor Carrier Safety Regulations for haulers transporting heating fuel, including propane, natural gas and heating oil, or providing other direct assistance, into eight Midwestern states.
