Stop the clock: Proposed hours of service overhaul would allow drivers to pause 14-hour countdown
FMCSA announced its proposal to reform hours of service regulations. Chief among the changes is the proposal to allow drivers to pause their 14-hour on-duty time for up to three hours, and expanding the split-sleeper option to 7/3, beyond the current 8/2. Full details here…

The mandate’s last roundup: The AOBRD-to-ELD shift
The final major deadline in implementing the electronic logging device mandate isn’t causing quite the stir as did the mandate’s initial effective date in 2017, yet for those grandfathered in to continue using AOBRDs, their impending sunset on Dec. 17 means adjusting to a device with a more rigidly detailed set of specifications that require some operational changes.

California court battles over independent contractor ‘ABC test’: One case stayed while another proceeds
The California Trucking Association’s case against use of the problematic “ABC test” in determining appropriate independent contractor classification, has been stayed as of last week, pending the outcome of a similar case already at the Ninth Circuit Court of Appeals.

Comment period for FMCSA pilot program for under-21 interstate truckers ends next week
Drivers and interested parties can now comment on the proposal through Aug. 14. The proposal would expand the current under-21 program for military-trained drivers to drivers under the age of 21 that were not trained to drive trucks in the military.

Missouri-based trucker shut down following fatal crash
According to FMCSA, trucker Bruce Andrew Pollard was driving a tractor-trailer in a work zone along I-465 eastbound in Indianapolis on July 14 when his truck, traveling faster than the posted speed limit, collided into a line of vehicles. Two young children and their mother were killed, and seven others were hospitalized.

The Commercial Vehicle Safety Alliance announced commercial vehicle inspectors conducted 10,358 inspections across the U.S. and Canada and sidelined 1,667 (16.1%) of those trucks.

FMCSA renews hours exemption for paper company drivers
WestRock to allow its Chattanooga, Tennessee, paper mill drivers to occasionally work up to 16 consecutive hours and return to work with less than 10 consecutive hours off duty. The drivers travel on approximately 275 feet of public road between the shipping and receiving departments shuttling trailers.

The DOT, in order to find the 2019 adjustment amount, had to multiply the penalty amount by the percentage change between the October 2018 Consumer Price Index for All Urban Consumers (CPI-U) and the October 2017 CPI-U, which this year was 1.02522.

The Federal Motor Carrier Safety Administration is now accepting feedback on what freight is considered agricultural commodities and to what extent haulers of those commodities should receive exemptions from federal hours of service regulations.

Comment period opens for proposed CDL knowledge test change
The rule, if made final, would not require states to offer CDL knowledge tests to out-of-state drivers, but it would give states the option to offer the tests, then transmit the results to the driver’s home state, which would then be required to accept the results.
