Senate DOT bill, unlike House, skips changes to ELD mandate, driver breaks
The Senate’s 2018 fiscal year DOT appropriations does not include any changes to the coming electronic logging device mandate, nor does it include the so-called Denham Amendment, which intends to block states from enacting rest break laws for truck drivers. The House version of the bill does include such reforms.

While the Federal Motor Carrier Safety Administration has taken steps to hone in on high-risk carriers — and intervene more quickly for investigations — the agency must continue to improve its intervention tactics, according to a report issued Thursday by the Department of Transportation’s Office of Inspector General.

FMCSA: Pre-2000 ELD exemption applies to engine model year, not chassis
Owner-operators with trucks equipped with model year 1999 engines and older will not be not subject to the electronic logging device mandate, regardless of the model year of the truck, according to fresh guidance from FMCSA.

Trump DOT nixes sleep apnea rulemaking, bumps speed limiter mandate
The U.S. Department of Transportation, as expected under the Trump administration, has signaled it will not continue to pursue a rulemaking to mandate the use of speed limiters in the trucking industry, at least any time soon. However, the DOT still considers instituting sleep apnea screening protocol for truck operators and carrier employers as a near-term priority.

Out-of-service conditions related to ELDs
The Commercial Vehicle Safety Alliance’s updated out-of-service criteria include those related to electronic logging devices. None are new OOS conditions. Rather, they’re footnotes related to current OOS conditions having to do with the hours of service, namely having no log book, having no previous seven days of logs and presenting a false log. All require putting the driver OOS for 10 consecutive hours.

Bill to delay ELD mandate two years filed in House
If enacted, owner-operators would have two additional years, to December 2019, to switch from paper logs to an electronic logging device. The bill has hurdles to clear before becoming law, however.

The Federal Motor Carrier Safety Administration has added an online tool that allows manufacturers of electronic logging devices to test whether their records of duty status (RODS) files will transfer properly to enforcement officers during roadside inspections.

A bill introduced by the Senate’s Commerce Committee this week would permanently disqualify truck drivers from holding a CDL if they’ve been convicted of a human trafficking offense. The legislation part of a two-bill package aimed at combating human trafficking that occurs on U.S. roadways.

A bill that would exempt carriers from state laws requiring paid meal and rest breaks for drivers and, at least short term, exempt livestock haulers from compliance with the federal electronic logging device has been passed by the House Appropriations Committee’s transportation subcommittee.
