Avoid getting stiffed: New flag on brokers with bonds pending cancellation can be effective recon tool
If a surety provider’s notice of cancellation of a broker’s bond can’t result in an immediate suspension because of “the need for rulemaking,” as FMCSA has noted, “that is a catch-22,” one watcher says, a “stretch of highway 100 miles long” with no stop signs against a fradulent broker doing business with no intent to pay. FMCSA officially nixes rule on increasing minimum liability insurance required for carriers
Ultimately, the agency says it received too little feedback, particularly from insurance companies, to proceed with a rulemaking. FMCSA sought to quantify whether the current $750,000 minimum, set in 1985, was too low to cover modern liability claims.
