DOT calls for train operators to be screened for sleep apnea, FMCSA holding off
FMCSA and the Federal Railroad Administration worked together on a sleep apnea rulemaking earlier this year, but FRA is already making recommendations to have train operators screened for apnea during their DOT-required exams. FMCSA says it will not follow FRA’s lead — yet.

OOIDA accuses FMCSA of sidestepping rule process with sleep apnea provision, files legal challenge
OOIDA filed its legal challenge Nov. 11, seeking to vacate the rule either in part or in whole. OOIDA says the final rule, which required procedural changes for medical examiners, included an appendix not found in the agency’s 2014 proposal that could subject some truckers to sleep apnea screening.

Truckers with high BMI would be forced into apnea screening under FMCSA committee recommendations, drivers respond
The committees recommend FMCSA require certain truckers to be screened for sleep apnea based on their BMI and other risk factors. Truckers with a BMI of 33 or higher would also be subject to screening if they meet three other qualifiers, a list that includes being male and being older than 42 — a large demographic among truckers.
