Two weeks remain to formally comment on speed limiter rule proposal

If the rule were to be made final, all new trucks would be required to use electronic speed governors. There is also a possibility it will require all trucks with factory-equipped speed limiters to be governed as well.

The exemption from the 30-minute rest break rule is limited to drivers transporting hazmat loads that have filed security plans requiring the drivers to constantly “attend” to the cargo.

The proposed rule outlined classroom training that would require instruction on the basics of driving a truck, including instrument and control instruction, how to perform pre- and post-trip inspections, how to safely back to a dock, hours-of-service regulations and more.

Trucker who crashed truck while drunk, changing pants shut down by FMCSA

Allen R. Johnson Sr. told Vermont State Police after the Nov. 2 accident that he had set the cruise control on the truck to 63 miles per hour, then stood up to change his pants. A report from the state indicated Johnson’s blood alcohol content was .209, approximately five times the legal limit for truck drivers.

OOIDA accuses FMCSA of sidestepping rule process with sleep apnea provision, files legal challenge

OOIDA filed its legal challenge Nov. 11, seeking to vacate the rule either in part or in whole. OOIDA says the final rule, which required procedural changes for medical examiners, included an appendix not found in the agency’s 2014 proposal that could subject some truckers to sleep apnea screening.

FMCSA: Repair Keith Huber Inc. cargo tanks or remove from service

FMCSA says the DOT 407 low-pressure bulk liquid cargo tanks and DOT 412 corrosive cargo tanks manufactured by the company have several defects that don’t comply with regulations. The tanks were manufactured before May 1, 2013, when the company went out of business.

After four more states voted to approve legalization of marijuana Tuesday, it appears the Department of Transportation will stand by its previous stance that using marijuana is forbidden for truck drivers as long as it remains a Schedule I drug.

Court rules PSP reports don’t violate driver privacy

In 2014, six truckers filed a class action suit, but the federal district court rejected arguments that FMCSA’s inclusion of less serious violations in PSP reports violates applicants’ privacy and that the agency lacks authority to release it.

A federal appellate court ruled that FMCSA’s Pre-employment Screening Program, which allows carriers to access the past five years of a potential employee’s crash data, the last three years of inspections and “serious safety violations for an individual driver,” does not violate drivers’ privacy.

DOT adds 30 days to speed limiter comment period

Comments on the propose rule are now due by the end of the day Dec. 7. The rule doesn’t specify a speed to which trucks would be governed.
