Part of drug/alcohol database rule could be delayed; bulk of rule still slated to take effect in January
The proposal would delay the compliance date for states from Jan. 6, 2020. The January 2020 compliance date would still remain in place for all other requirements of the Clearinghouse rule, including the requirement fleets query the database for all new hires, as well as once a year for all existing drivers.

Do we need a rulemaking on crash ‘preventability’ as a standard for removal from carrier scores?
Yes, according to the Motor Carrier Regulatory Reform coalition. Too many around the industry conflate “preventability” with fault, creating blowback potential particularly for truckers with accidents on their record for which they have no legal liability yet that get deemed “preventable” and labeled as such.

FMCSA waiving Temporary Operating Authority Registration fees for Hurricane Dorian
The waiver of the fees will continue until the end of the agency’s regional emergency declaration, which will expire at the end of the emergency or Sept. 28, whichever is sooner, unless the declaration is extended.

FMCSA and the Wisconsin Department of Transportation say companies and websites that want drivers to pay to file their biennial update with FMCSA are not associated with the U.S. DOT or WisDOT. Filing can be done for free on government websites.

Second FMCSA listening session on hours of service set for D.C.
The second of the Federal Motor Carrier Safety Administration’s listening sessions on the proposed hours of service changes will be held Tuesday, Sept. 17, at U.S. DOT headquarters in Washington, D.C. The listening session will be held from 1-3 p.m. and is open to the public.

Carriers with one or two trucks paid $69 in 2018 and $62 in 2019. Under the new proposal, these companies would pay $60 for their 2020 UCR fees.

Hours overhaul a little slow out of the gate
The U.S. DOT’s proposal to revamp federal hours of service regulations still hasn’t been officially published in the Federal Register, though an agency spokesperson says the notice of proposed rulemaking teed up for publication Thursday.
