Senators press regulators to speed up implementation of driver drug testing changes
The senators noted in the letter the December 2015-passed FAST Act highway bill required the HHS to issue guidelines for hair testing as a method of detecting the use of drugs within one year, but the Dec. 4, 2016, deadline passed without action. Failing to meet the deadline, the letter adds, has prevented the DOT from allowing hair testing to be a federally approved testing method.

DOT declines to file opposition in ELD lawsuit’s appeal to Supreme Court
The attorney representing OOIDA and truckers Richard Pingel and Mark Elrod in the ELD challenge says it’s not uncommon for the government to decline to file in such court cases. However, he says, the Supreme Court could ask DOT to file an opposition brief before deciding to hear the case or not.

Fireworks hauling group seeks hours exemption for another member company
An exemption granted last year by FMCSA allows 51 carriers to operate outside of compliance of the 14-hour rule. The exemption is good through 2020. The new request would, if granted, add Pyro Shows of Alabama to the list of companies waived from compliance with the 14-hour rule in the weeks surrounding July 4.

Two-truck Alabama fleet shut down following fatal crash, violations
Jeffery Finklea of Beatrice, Ala., was ordered to shut down his two-truck operation on April 24. FMCSA says a truck operated by J&L crossed the center line of Alabama Highway 13 on March 28 and collided head-on with a passenger car, killing both of its occupants.
