A sleep apnea rule would give clarity to medical examiners, carrier employers and drivers themselves about what criteria or combination of criteria would prompt a driver to be referred for an in-lab apnea test. The agencyās withdrawal of the rule preserves the status quo.

New FMCSA guidance allows states to accept commercial learnerās permit applications from any out-of-state drivers
The guidance issued this week is in line with FMCSAās final rule issued Oct. 13, 2016, that amended CDL regulations to ease the transition of military personnel into the trucking industry. Previously, states could only accept out-of-state applications from military personnel, but the new guidance applies to all drivers.

Lawsuit seeks to halt FMCSA's non-domiciled CDL final rule
That latest filing in the case of owner-operator Jorge Rivera Lujan v. the Federal Motor Carrier Safety Administration asks for an emergency stay of the government's final rule restricting non-domiciled CDL eligibility, pending judicial review.
