FMCSA on ELDs: Longtime ‘government supervision’ of trucking justifies privacy intrusion
Relative to ELDs potential to infringe on truckers’ privacy, FMCSA argues that’s simply part of being a truck driver. Trucking has a “‘long tradition of close government supervision,’” the agency says, citing a 1987 court decision. Truckers should have a lower expectation of privacy while on the job because of it, FMCSA’s lawyers argue in their court brief.

DOT chief: CSA scores likely to remain hidden for two years pending required changes
“Based on our preliminary assessment, it’s going to take a while to do the revised analysis,” Foxx said, referring to the changes in the CSA score methodology called for by Congress in the 2015 FAST Act. “We expect it to take a year or two, probably more like two, before that information (CSA SMS rankings) will be posted back up.”

Court strikes down Calif.’s emissions regulations compliance options for owner-operators
A California Superior Court ruled last week to strike down several 2014-made amendments to the state’s strict emissions rules. The amendments meant to give compliance flexibility to owner-operators and other small fleet owners who may have trouble affording equipment upgrades or add-ons to bring their trucks into compliance.

Truck operator fired for refusing to drive amid HOS concerns could get $275k from carrier
NFI fired the driver in 2012, a day after he refused to deliver a load to its original destination. OSHA says severe weather, flooded roads, traffic and crashes caused the trip to take much longer than anticipated. Per OSHA, the driver “believed he lacked sufficient time to complete the deliver and return home without violating” hours regs.

The standards will begin taking effect for trailers in 2018. Tractor requirements take effect in 2021. The plan goes through 2027, when the entire vehicle – engine, truck and trailer – will be required to meet the standards.
