AA&E hauler petitions FMCSA for split sleeper flexibility for team drivers
PTS Worldwide, which transports sensitive Department of Defense property including ammunition and explosives, in interstate commerce is petitioning the Federal Motor Carrier Safety Administration to allow its team drivers to split sleeper berth time into 6/4, 5/5 or 4/6 hours.

Drivers, carriers offer mixed reactions to proposed hours changes
Many comments already submitted agree with the proposed changes, while others think it will allow carriers to extend drivers’ working day by three hours. Other commenters mostly agree with the changes but would prefer more flexibility with the 30-minute break and the sleeper berth split.

Comment period for proposed hours of service overhaul extended through Oct. 21
FMCSA announced in a Federal Register notice to be published Thursday, Sept. 19, it has extended the comment period from Oct. 7 to Oct. 21. The 14-day extension effectively gives the hours proposal a 60-day comment period from the time it was published Aug. 22.

34-hour restart regs rebuffed by Congress in 2014 officially nixed from rulebook
The regulations, which have not been enforced since December 2014, limited truck drivers to one restart per week and required the restart to include two 1 a.m. to 5 a.m. periods. Those regulations were suspended by Congress in December 2014, though they technically remained on the books.

Second FMCSA listening session on hours of service set for D.C.
The second of the Federal Motor Carrier Safety Administration’s listening sessions on the proposed hours of service changes will be held Tuesday, Sept. 17, at U.S. DOT headquarters in Washington, D.C. The listening session will be held from 1-3 p.m. and is open to the public.

Hours of service listening session set for GATS
The GATS listening session, which will be at the Kay Bailey Hutchison Convention Center, will begin at 10 a.m. and is scheduled for two hours. FMCSA says the listening sessions will allow the public to present comments, views and relevant research on the proposed hours changes.

The Federal Motor Carrier Safety Administration is now accepting feedback on what freight is considered agricultural commodities and to what extent haulers of those commodities should receive exemptions from federal hours of service regulations.

In its latest rulemakings update, the Federal Motor Carrier Safety Administration lists July 31 as its projected publication date for its proposal to reform federal hours of service regulations. The date is not binding and could change.

Currently, the agency defines ag commodities as “any agricultural commodity, nonprocessed food, feed, fiber, or livestock,” but that definition could change should the agency proceed with the rulemaking process after it solicits feedback with this ANPRM.

Group wants turfgrass sod included as ‘ag commodity’ for hours exemptions
Currently, drivers hauling ag commodities operate under certain HOS exemptions, such as the 150-air-mile radius exemption that allows drivers carrying ag commodities to skip recording duty status if they stay within a 150-air-mile radius of the source of the commodity, among others.
